《教育部直属高校实验室安全事故事件追责问责办法(试行)》构成实验室安全责任事故事件的行为包括:
(一)存在违规购买、储存、使用、运输、转让或处置危险化学品(尤其是包括剧毒、易制毒、易制爆、爆炸品、麻醉药品、精神药品等在内的管制类化学品)、特种设备、放射性同位素及核材料、射线装置、危险废物等,或未采取必要的措施导致被盗或遗失,或发生上述情况未及时报告上级有关部门;
(二)存在未进行相应等级生物安全实验室备案,在实验室内使用超出其生物安全许可范围的生物材料或进行超出其生物安全等级的操作,违规开展动物实验等情况;
(三)发现安全隐患,或接到整改通知,拒不整改或整改不到位; 未经许可擅自启用被封实验室或实验设施设备;
(四)存在未落实实验人员的实验室安全教育和实验室准入制度、项目安全审核制度等情况;
(五)存在未制定必要的操作规程,未制定必要的应急预案等情况;
(六)发生实验室安全事故后,未积极采取处置措施、迟报瞒报谎报漏报、人为破坏事故现场等;
(七)存在其他违反国家法律法规、违反安全管理相关规定、未履行安全管理职责的行为。
Notice on the Announcement of Reporting Method of Potential Safety Hazards in Laboratories
To Schools/Institutes/Centers:
In order to improve the investigation of potential safety hazards and safety control system of our university laboratories, timely discover and eliminate potential safety hazards, and prevent laboratory accidents, in accordance with the requirements of the Laboratory Safety Norms for Higher Education Institutions” issued by the Ministry of Education, the reporting methods for safety hazards in laboratories are hereby announced as follows:

According to the Measures for Accountability and Responsibility for Laboratory Safety Accidents in Directly Affiliated Universities of the Ministry of Education (Trial Implementation), behaviors that constitute laboratory safety responsibility accidents include:
(1) Purchasing, storing, using, transporting, transferring or disposing of hazardous chemicals (especially controlled chemicals including highly toxic, precursor toxic, explosives, anesthetics, psychotropic substances, etc.), special equipment, radioisotopes and nuclear materials, radiation devices, hazardous wastes, etc., or failing to take necessary measures resulting in theft or loss, or failing to report the above situation to the relevant department in a timely manner.
(2) Failing to file for corresponding biosecurity laboratory certification, use of biological materials beyond its biosafety license scope, or conducting operations beyond its biosecurity level, or conducting animal experiments in violation of regulations.
(3) Failure to address identified safety hazards or comply with rectification notices; unauthorized use of sealed laboratories or laboratory facilities and equipment.
(4) Failure to implement laboratory safety education and laboratory access systems for laboratory personnel or project safety review systems.
(5) Failure to develop necessary operating procedures, emergency plans, and other related issues.
(6) Failure to take active measures to deal with laboratory accidents, delayed reporting, concealing, lying, or omissions in reporting, or deliberate destruction of the accident scene.
(7) Other behaviors that violate national laws and regulations, violate relevant safety management regulations, or fail to fulfill safety management responsibilities.
